We are a smart and intuitive online filter engine that allows searching and obtaining customised results based on your own real life experiences, preferences, target market, interests and personality (our “Services”). Our site is made available free of charge. However we may allow our users to upgrade to premium features which will be based on categories.

By using our site, you confirm that you are an adult and accept these terms of use and that you agree to comply with them. Please read them carefully. If you do not agree to these terms, you must not use our site.

You are not to misuse our Services. You should not interfere with our Service or try to access them using a method other than the interface and the instructions that we provide. You may use our Services only as permitted by law.

We may suspend or stop providing our Services to you if you do not comply with our terms or policies or if we are investigating suspected misconduct.

Using our Services does not give you ownership of any intellectual property rights in our site or the content you access. You may not use content from our site unless you obtain permission from its owner or are otherwise permitted by law. You also agree:

We may review content to determine whether it is illegal or violates our policies, and we may remove or refuse to display content that we reasonably believe violates our policies or the law. But that does not necessarily mean that we review content, so please don’t assume that we do.

If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential. Our Service is available on mobile devices. Do not use our Services in a way that curtails or distracts your mobility.

YOUR ACCOUNT TOSCALE

You may need to create an Filter:Scale Account in order to use some of our Services. To protect your Account, keep your password confidential. You are responsible for the activity that happens on or through your Account. Try not to reuse your Account password on third-party applications. If you learn of any unauthorized use of your password or Account, change or reset your password.

YOUR CONTENT IN OUR SERVICES

Some of our Services allow you to upload, submit, store, send or receive content. You retain ownership of any intellectual property rights that you hold in that content. In short, what belongs to you stays yours.

Whenever you make use of a feature that allows you to upload content to our site, or to make contact with other users of our site, you must comply with the standards set out in these terms.

You warrant that any such contribution does comply with those standards, and you will be liable to us and indemnify us for any breach of that warranty. This means you will be responsible for any loss or damage we suffer as a result of your breach of warranty.

SOFTWARE IN OUR SERVICES

When our Services require or include downloadable software, this software may update automatically on your device once a new version or feature is available. Some Services may let you adjust your automatic update settings.

No third party rights: These terms control the relationship between ToScale and you. They do not create any third party beneficiary rights.

Non-compliance with these Terms: If you do not comply with these terms, and we do not take action right away, this does not mean that we are giving up any rights that we may have (such as taking action in the future).

Severability: If it turns out that a particular term is not enforceable, this will not affect any other terms.

Governing law: Please note that these terms of service, their subject matter and their formation, are governed by English law. You and we both agree that the courts of England and Wales will have exclusive jurisdiction except that if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are resident of Scotland, you may also bring proceedings in Scotland. If you are a business, these terms of use, their subject matter and their formation (and any non-contractual disputes or claims) are governed by English law. We both agree to the exclusive jurisdiction of the courts of England and Wales.
